Free Tier Terms of Service

These Free Tier Terms of Service (the "Free Tier Terms") govern access to and use of the free tier of TrustPin, including its dashboard, APIs, SDKs, configuration-delivery services, documentation and related features (the "Free Tier").

TrustPin is operated by Capa7 LLC, a Wyoming limited liability company ("Capa7", "we", "us" or "our"), 1007 N Orange Street, 4th Floor, Suite 3317, Wilmington, DE 19801, United States.

By creating an account, accessing the dashboard, calling the APIs, integrating an SDK or otherwise using the Free Tier, you accept these Free Tier Terms on your own behalf and, where applicable, on behalf of the company or organization you represent, and you confirm that you have authority to do so. If you do not accept these Free Tier Terms, do not use the Free Tier. The Free Tier is intended for business, professional and development use. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Free Tier.

Website use

The public TrustPin website at trustpin.cloud, including its content, documentation and white papers, is provided for general information "as is" and without warranties. You may not scrape, copy, republish or misuse website content, interfere with the website's operation, or use it to build a competing service. All website content and trademarks remain the property of Capa7 or its licensors. Use of the TrustPin dashboard, APIs and SDKs under the free tier is governed by these Free Tier Terms; paid subscriptions are governed by the signed agreement described in Section 1.

1. Scope; paid plans

These Free Tier Terms apply only to the Free Tier. Paid subscriptions are governed exclusively by the TrustPin Customer Subscription and Support Agreement (or another written agreement signed with Capa7) together with the applicable Order Form; if you purchase a paid plan, that agreement (not these Free Tier Terms) governs the paid services, and prevails in case of conflict with respect to them. Nothing in these Free Tier Terms grants you any support, availability, warranty, indemnity or service-level commitment offered under any paid plan.

2. License

Subject to these Free Tier Terms, Capa7 grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to use the Free Tier for your internal business and development purposes during the period Capa7 makes the Free Tier available to you. All rights not expressly granted are reserved. TrustPin, the TrustPin name and logo, and all related intellectual property remain the property of Capa7 or its licensors.

TrustPin SDK and CLI source code published by Capa7 in public repositories is licensed under the open-source license stated in the applicable repository; these Free Tier Terms govern your use of the TrustPin service that the SDKs and CLI connect to, not the SDK or CLI source code itself. If there is a conflict, the repository license governs the source code and these Free Tier Terms govern the service.

3. Acceptable use

The TrustPin Acceptable Use Policy, as updated from time to time, forms part of these Free Tier Terms. You must comply with it at all times. In particular, you must not use the Free Tier in high-risk systems where failure could reasonably be expected to cause death, personal injury or severe physical, environmental or infrastructure damage.

4. Your responsibilities

You are solely responsible for:

• all activity under your accounts, credentials, tokens, projects and integrations, and for keeping them secure;
• validating certificate and public-key pins, maintaining backup pins and rotation plans, and thoroughly testing your integration before relying on it in any production application;
• your own applications, infrastructure, DNS, CDN and network configuration;
• maintaining your own exports, backups and business-continuity arrangements;
• ensuring your use of the Free Tier is lawful and that you have all rights and permissions for any data or materials you provide.

You acknowledge that incorrect pinning configuration, missing backup pins or reliance on a single delivery path can cause your applications to lose connectivity, and that avoiding this through proper configuration and testing is your responsibility.

Sign-in through third-party identity providers such as Google or GitHub is subject to those providers' own terms and privacy policies. Capa7 is not responsible for third-party identity providers or for loss of access caused by them.

5. Free Tier availability, limits and changes

The Free Tier is provided at Capa7's discretion. Capa7 may modify, limit, throttle, suspend, convert or discontinue the Free Tier or any of its features, quotas or limits at any time, with or without notice, and without liability. Capa7 has no obligation to provide support, maintenance, updates, uptime, storage or data retention for the Free Tier, and no obligation to maintain any Free Tier account, project or configuration after suspension, closure or discontinuation.

The Free Tier is subject to structural limits (including the number of projects and the number of domains per project) and to fair use. It is intended for evaluation, development and small production workloads. Configuration delivery under the Free Tier is served from shared content-delivery capacity funded by Capa7; accordingly, Capa7 does not publish a fixed usage cutoff and instead assesses fair use by reference to request volume, bandwidth, storage and the load your usage places on shared infrastructure relative to typical Free Tier usage.

Where your usage materially exceeds fair use, Capa7 will normally contact you at the address associated with your account and give you a reasonable opportunity to move to a paid plan. Capa7 may, however, throttle, rate-limit, suspend or terminate Free Tier access immediately and without prior notice where usage threatens the stability, security, performance or cost of the Service for other users. You must not create or operate multiple Free Tier accounts or organizations, or otherwise shard or distribute a single workload, in order to exceed or circumvent Free Tier limits.

No service-level agreement, uptime commitment, availability target, service credit, support response time or remedy of any kind applies to the Free Tier. The TrustPin Service Level Agreement and any published availability targets apply exclusively to paid plans under a signed agreement. Availability, performance and support for the Free Tier are provided on a commercially reasonable-efforts basis only, subject to Sections 6 and 7.

6. No warranty

THE FREE TIER IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY OR UNINTERRUPTED OR ERROR-FREE OPERATION, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (a) CAPA7 WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITY, OR FOR ANY APPLICATION DOWNTIME, CONNECTIVITY FAILURE OR SERVICE INTERRUPTION, ARISING OUT OF OR RELATING TO THE FREE TIER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (b) CAPA7'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE FREE TIER WILL NOT EXCEED ONE HUNDRED US DOLLARS (USD 100). YOUR SOLE RECOURSE FOR ANY CLAIM IS TO THE ASSETS OF CAPA7 LLC; NO MEMBER, MANAGER, OFFICER, EMPLOYEE OR AGENT OF CAPA7 HAS ANY PERSONAL LIABILITY. NOTHING IN THESE FREE TIER TERMS EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED.

8. Indemnity

You will defend and indemnify Capa7 against third-party claims, losses and expenses (including reasonable attorneys' fees) arising from your data or materials, your applications or infrastructure, your breach of these Free Tier Terms or the Acceptable Use Policy, or your unlawful or unauthorized use of the Free Tier.

9. Export control and sanctions

You may not use the Free Tier if you are located in, or ordinarily resident in, a country or territory subject to comprehensive US sanctions, or if you are listed on, or owned or controlled by a person listed on, any US government restricted-party list. You must comply with all applicable export-control and sanctions laws in connection with your use of the Free Tier.

10. Data protection

Capa7 processes personal data as described in the TrustPin Privacy Policy and uses the third-party providers identified in the sub-processor list. The Free Tier is not intended for special-category or highly sensitive personal data. A data processing addendum with Standard Contractual Clauses is available with paid plans.

11. Feedback

If you provide feedback, suggestions or ideas about TrustPin, Capa7 may use them without restriction or obligation to you.

12. Suspension and termination

You may stop using the Free Tier and close your account at any time. Capa7 may suspend or terminate your access to the Free Tier at any time, with or without cause or notice. After closure or termination, Capa7 may delete account data and configurations in accordance with its standard retention practices, and has no obligation to retain or export your data.

13. Changes to these terms

Capa7 may update these Free Tier Terms from time to time by posting the updated version at this page with a revised "Last updated" date. Your continued use of the Free Tier after an update constitutes acceptance of the updated terms. Urgent changes required for security, legal compliance or prevention of harm may take effect immediately.

14. Governing law and forum

These Free Tier Terms are governed by the laws of the State of Delaware, United States, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. The state and federal courts located in Wilmington, Delaware have exclusive jurisdiction, and each party irrevocably waives, to the fullest extent permitted by law, any right to a jury trial. To the maximum extent permitted by applicable law, any claim arising out of or relating to the Free Tier must be brought within twelve (12) months after the claim arose, and all claims must be brought in the parties' individual capacity, and not as a plaintiff or class member in any class, collective or representative proceeding.

Nothing in this section deprives you of mandatory protections under the laws of your place of residence where those protections cannot be waived by contract.

15. General

These Free Tier Terms, together with the documents they incorporate by reference, are the entire agreement between you and Capa7 regarding the Free Tier. If any provision is unenforceable, the remainder stays in effect. Capa7's failure to enforce a provision is not a waiver. You may not assign these Free Tier Terms without Capa7's prior written consent; Capa7 may assign them in connection with a merger, acquisition or sale of assets. Capa7 is not liable for delays or failures caused by events beyond its reasonable control.
